What is the development tax for a shell pool?

The development tax is a local tax levied by your municipality, your department, and, only in Île-de-France, by the region. Unlike property tax, which is levied annually, the development tax is paid only once, when you obtain your planning permission (prior declaration or building permit).

The amount depends on three criteria: 

  • the surface of your pool, 
  • a national flat-rate value set each year, 
  • and the rates voted by the local authorities in your area.

An in-ground or semi-inground pool, including a shell pool, is automatically subject to this tax if its surface area exceeds 10 m². However, mini pools smaller than 10 m² are completely exempt.

How is the development tax for a swimming pool calculated?

The calculation of the development tax is based on a simple formula, but one that requires a clear understanding of each of its components:

Pool surface area (m²) × $251 × (Municipal tax rate + County tax rate + IDF regional tax rate)

1. The surface area of your fiberglass pool

For a shell pool, this is the surface area of the water, calculated by multiplying the length by the width. 

For example, the tax implications for an 8×4 pool (8 meters long by 4 meters wide) is based on a reference surface area of 32 m². For more elaborate shapes of our pools, the surface area is precisely indicated in the technical specifications of the model.

2. The flat-rate value for 2026 

Set at €251 per square meter for all swimming pools in France (excluding Île-de-France for conventional constructions, which have a different scale), this value forms the basis for the calculation imposed. 

It is updated annually on January 1 based on the construction cost index published by INSEE.

3. Local variable rates 

This is where the main variability in the final amount lies:

  • The municipal rate can vary from 1% to 5%, or even up to 20% in certain specific urban areas or sectors requiring significant public infrastructure.
  • The departmental rate is capped at a maximum of 2.5% and remains the same for the entire department;
  • The regional rate applies only in Île-de-France, up to a limit of 1%.

The schedule and terms of payment for the development tax

Payment of the development tax is made according to a specific schedule, which it is important to be aware of in order to plan ahead:

  1. Planning permission: Once you have obtained your planning permission (in most cases, a preliminary declaration of work for a swimming pool) that the tax is calculated.
  2. Declaration of completion of work: You must declare the completion of your work within 90 days of the end of the project via your personal account on impots.gouv.fr, under the "Real estate" section.
  3. Receipt of the notice: The tax authorities will then send you one or two payment notices depending on the amount:
  • Amounts less than €1,500: a single payment, due 90 days after completion of the work
  • Amounts over €1,500: two equal payments, the first 90 days after completion, the second six months later
